Vendors may have commitments to purchase other property dependent on financing from the purchaser.  Opportunities to relist or resell the property may have evaporated.  Purchasers may have vacated other property and be in mid-move into the new premises.  In the case of residential real estate transactions, these “inconveniences” can lead to significant costs and difficulties for the parties involved.

We provide real-time dispute resolution on real estate transactions to allow the parties to reach interim and permanent solutions to allow the transaction to close, to allow purchasers to move in to the property, and to enable financial solution that assist all parties to minimize the cost impact of a dispute without increasing the inconvenience to everyone involved.

Our typical resolution processes include mediation, mediation-arbitration and issue-specific arbitration.

Upon closing of a sale, we also provide we provide full scale dispute resolution (including mediations and arbitrations) to allow for final resolution of disputes in a timely and cost-effective manner.

We also work with legal counsel and real estate agents to include alternative dispute resolution mechanisms in offers to purchase and in agreements of purchase and sale.

Real Estate Mediation

Real estate is a fairly new field of mediation yet the benefits are boundless for both the buyer and the seller.  How many times have deals been lost because sale or purchase conditions seemed insurmountable for the parties?  Real estate mediation allows both parties to sit with a neutral facilitator to seek solutions which may be beneficial to all.  Where negotiation of terms for purchase or sale can take days or weeks, parties can quickly explore mutual interests and find possible win-win solutions.  Mediation can also address issues of dispute that may arise between buyers and sellers as well as their brokers.
